Amnesty 2026: is there one? Emersione and alternatives

2026 amnesty for foreigners: in October 2026 Italy has no new amnesty. 2020 emersione cases and alternative routes, assessed case by case.

Who it is for: For people who live in Italy without a permit and are looking for regularisation, and for people who still have a 2020 emersione case open.

The steps of the case

  1. 1

    Listening to your situation

We reconstruct since when you have been in Italy, what you have done, who you live and work with. Every detail can open or close a route.

  2. 2

    Checking the possible routes

We check whether there are routes open to you today: protection, family ties, minor children, victims of exploitation, return with the flows decree.

  3. 3

    2020 emersione cases still open

If you applied for emersione (regularisation of work relationships) in 2020, we check how your case is going and what to do if it is stuck or rejected.

  4. 4

    Starting the chosen route

If there is a concrete route, we prepare the application or, when a judge is needed, the office's in-house lawyers follow it.

Is there an amnesty in 2026?

No. In October 2026 no amnesty is open in Italy for foreign citizens without a permit. The last extraordinary regularisation is the emersione of work relationships under Art. 103 of Decree-Law 34/2020 (the “Relaunch decree”), with applications submitted in the summer of 2020.

From time to time people talk about new amnesties, including the one approved in Spain in 2026. In Italy, however, today there are only proposals from associations and campaigns, not a law. If an amnesty is approved, we will update this page.

Beware of scams. Nobody can sell you a place in an amnesty that does not exist. Beware of anyone who asks for money while promising shortcuts.

The 2020 emersione: cases still open

In 2020 the regularisation covered only some sectors: agriculture, livestock and fishing, domestic work and personal care. It could be done with the employer or, in some cases, by asking for a temporary permit.

Some of these cases are still being processed or were rejected. If you have a 2020 application, keep the receipt: we check the status of your case and, if needed, assess a reminder or an appeal.

The routes that exist today

Even without an amnesty, in some cases the law offers concrete routes. They are not for everyone: they must be checked against your own story.

  • International protection or special protection, if you risk persecution or serious harm in your country, or if in certain cases removal would breach your family and private life in Italy.
  • Article 31, if you have minor children in Italy and your presence is needed for their development: the Juvenile Court (Tribunale per i minorenni) decides.
  • Permit for victims of labour exploitation (Art. 18-ter Legislative Decree 286/1998, introduced by Decree-Law 145/2024): it lasts one year (since Decree-Law 146/2025, before it was 6 months), can be renewed and at expiry can be converted into work or study, outside the quotas.
  • Permit for victims of trafficking or violence (Art. 18 Legislative Decree 286/1998).
  • Family members of Italian or EU citizens, who follow their own rules.

Common mistakes

  • Paying someone for an amnesty that does not exist.
  • Using false documents or fake contracts: besides being a crime, they close the real routes.
  • Not keeping proof of your presence in Italy.
  • Losing the communications of the 2020 emersione application.

How we help you

We tell you honestly whether a route exists for you today, and which one. If there is one, we follow it from beginning to end; when a judge is needed (protection, Article 31, appeals), the office’s in-house lawyers take care of it. If there is none, we tell you clearly.

  • First consultation: 60 €, about 30 minutes, in the office or online on WhatsApp.
  • Sofia, the office’s assistant, answers on WhatsApp in 8 languages and books your appointment: use the booking button on this page.

What to bring to the consultation

  • Passport or other identity document, even if expired
  • Proof of your presence in Italy (dated documents, receipts, medical certificates)
  • Receipt and communications of the 2020 emersione application, if you made one
  • Documents on family and children in Italy
  • Proof of work, even if irregular (messages, payments), if you have any
